Sir my father is Class III employee in under UP state government and his annual income is around 3.6 lakh and my mother is currently working in UP state govt aided school as a teacher at 4600 GP with annual income around 6.7 lakh.
Now the situation is that i applied for several state govt jobs in 2017...at that time my parents combine income is under 8 lakh so i used obc quota...and now selected in 2 state govt job but now they are asking for latest caste certificate...i have obc ncl certificate of jan 2017...but they need latest.
Should i still eligible for OBC NCL
Should i attend Document verification..or start applying for new jobs with UR category.
What should i do sir....pls help???
If i am still eligible...where it is written in any order about such situation.
Till march 2017 my parents combine salary under 8 lakh...but in january 2019 situation is different.
Sir pls help... document verification in next week.
Last 3 year rule apply here???? because not in every 3 year my parents income above 8 lakh or class 3 class 2 rule apply???
Hi gaurav,
You need not worry. You can renew your OBC Non-Creamy Layer certificate.
You are eligible for it. Some tahsildars may approve it immediately. Some would ask us to prove it through government document. Even in case if Thasildar rejects t agree you can go to collector office.
Proof:
Case 1:
Both are Govt employees. So their status alone matters.
your father being class 3, mother in class 2(if she takes classes for class 11,12).
So you normally falls under OBC Non creamy Layer.
Case 2:
If Mother working in govt. aided school. and gets salary from the trust and not from govt. then, she is not a govt employee.
ignore father's income as only his status should be considered. Mother's income should be taken. Her income is Rs.6.7 lakhs per annum. which is below 8 lakh limit.
So you can claim your certificate.

Thank you very much for clarifying this, already applied for latest OBC NCL Certificate.
And my mother also belong to Class 3 irrespective of 4600 GP (since she only takes classes upto 8).
Now i realised that teachers of govt. aided school not considered government employees.
Thank you again your help, it worth for me alot.
Please clarify one more thing if possible that now i get certificate on the basis of my mother annual income i.e. 6.7 lakh, but after one or two years when it exceeds 8 lakh.
Then what will be the scenario, class of both parents matters i.e. Class III or my mother's income individualy considered and i will belong to creamy layer in future (since she is not govt. employee so i think her class doesn't matter, income is considered).
I need your advice here because rules related to creamy layer is very ambiguous.
"Now I realised that teachers of govt. aided school not considered government employees."
- Sorry. I meant in every govt aided school, two categories of teachers work. Some are govt employees. Some are directly appointed by the trust or school associations(not a govt employee).
If a teacher is appointed by the trust and salary is given by that trust. Then she will come under private employee category.
In the previous reply, you have just stated she is working in govt aided school. So I have listed two cases.
Ask your mom if govt salary raise would impact her salary too.
If she says yes then case 1 applies. If she is underpaid by the trust/school association. Then case 2 applies.
Now I'm updating the answer after your recent information.
If your mother gets the salary from govt then need not worry. You are eligible for OBC Non creamy layer. No problem of her being class 2 or class 3.
If your mother doesn't get the salary from govt. 8 Lakhs rule applies. Average of last 3 years should be taken.
So if your mother's salary is 7 lakhs and got increased to 8 lakhs.
Avg for
2019- (7+7+8)/3 = 7.33 lakhs per annum
2020- (7+8+8)/3 = 7.66 lakhs per annum
2021- (8+8+8)/3 = 8 lakhs per annum - Then you will become OBC Creamy Layer
Thank you for the information sir.
My mother was appointed by school association (govt. aided school management has the power to appoint teachers) butthose employee get salary from govt. and yes govt. salary raise impact her salary too.
I think if she is getting salary from govt so she is cosidered as govt. employee and being both parents Class III i will be considered as Non creamy layer OBC.
But sir pls tell me that format of caste certificate will change in this case or it will remain same.( In certificate it is mentioned that income of last three years of parents is not above 8 lakh).
Even though was appointed by School association at the beginning. Teachers can receive salary from govt only if they have CTET/TET certificate.
So then literally it will be like appointed by Govt.
Even I may be wrong(Because it may only be prevalent in Southern India, but I hope not). Caste certificate format won't change.
You have to renew your certificate for every 6 months. Renewal will not be done once last 3 years average income crosses 8 lakhs limit.
"Renewal will not be done once last 3 years average income crosses 8 lakhs limit."
But sir according to the rule in my case status of parents should be considered (CLASS III) then I should get OBC NCL quota always irrespective of any income...am i right sir????
Yes, you can renew it any number of times. Your status(OBC NCL) won't change even if they earn more than 8 lakhs.
