My father is working in private sector...his annual income is more than 8 lakh per annum....do i belong to non creamy layer or not? ( Because in income and wealth test under category VI, it is written that income from salary should not be clubbed)
The provision is only for Agricultural income.
Agricultural income and income from salary should not be clubbed.
Eg: If My father earns 7 lakhs from salary and 7 lakhs from agriculture. So his total income is obviously more than 8 lakhs. But Both of them should not be clubbed.
1) On income from the salary test, I would come under OBC non creamy layer.
2) Agricultural landholding under State govt should be checked. If my father is holding land below limit I'm eligible for OBC Non-creamy layer. Else I will come under OBC Creamy Layer.
Sir can you please refer point number 10, on page number 9 of that DOPT memorandum....
In that, they have explained what is the scope of term 'income from salary and agriculture land shall not be clubbed'.

What you understand by reading is right. In that document point 9, 10 explains that 'Income from other sources' only should be taken for consideration. I see this as a weird statement. Who knows, even it may be a big loophole.
Try convincing Tahsildar.
Until then I will ask some other experts about this. Will hit back if I found something new.
Okk sir.... I am also trying...i asked this to officials of SDM office but even they also don't have clear idea. I have also contacted PMO, but my query is under consideration since 3 months.

You will not be eligible for reservation as your parents' income is more than 8 lakh. para 9 of DoPT memorandum pertains to posts where equivalence has not founded which include jobs in the private sector. Here salary is also included in calculating income. Only agri income is excluded here.
para 10 of the circular pertains to Group C and Group D of government employees where income from other sources excluding salary and agri income is taken into consideration.
